Terms of Service

Welcome to MetaFetch. These Terms of Service ("Terms") govern your use of the MetaFetch API service and website (collectively, the "Service") operated by MetaFetch ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

By creating an account or using the MetaFetch API, you acknowledge that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will use the Service in compliance with all applicable laws
• If using on behalf of an organization, you have authority to bind that organization

2. Description of Service

MetaFetch provides a domain enrichment API that allows you to retrieve company information based on domain names. The Service includes:

• REST API access for company data enrichment
• Dashboard for API key management and usage analytics
• Documentation and technical support
• Caching and data freshness guarantees based on your plan

3. Account Terms

To access the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Keep your API keys confidential and secure
• Notify us immediately of any unauthorized access
• Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these terms or exhibit suspicious activity.

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Scrape, redistribute, or resell our data without authorization
• Attempt to circumvent rate limits or usage restrictions
• Access or probe systems without authorization
• Interfere with or disrupt the Service infrastructure
• Send spam or unsolicited communications using our data
• Harass, stalk, or harm individuals using enriched data
• Build competing services using our data
• Use automated means to create accounts or generate API keys

Subscription Plans

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms or required by law.

Free Tier

The free tier is provided at our discretion and may be modified or discontinued at any time. Free accounts inactive for more than 90 days may be deleted.

Upgrades and Downgrades

You may upgrade your plan at any time, with the new rate taking effect immediately. Downgrades take effect at the start of the next billing cycle.

Overages

If you exceed your plan's monthly request limit, additional requests will be blocked until your limit resets. We do not charge overage fees; instead, you may upgrade your plan to increase limits.

6. API Usage

Rate Limits

Each plan includes specific rate limits. Requests exceeding these limits will receive a 429 (Too Many Requests) response. Persistent rate limit violations may result in account suspension.

API Keys

API keys are for your use only and may not be shared or distributed. You are responsible for all usage associated with your API keys. Compromised keys should be revoked immediately.

Data Usage

Data retrieved through the API may be cached locally for your internal business purposes. Redistribution, resale, or public exposure of bulk data is prohibited without written consent.

7. Intellectual Property

The Service, including its design, code, and documentation, is owned by MetaFetch and protected by intellectual property laws. You receive no ownership rights to the Service.

Company data provided through the API is sourced from public information and is provided "as-is" for your legitimate business purposes. Trademark and copyright in company logos and names remain with their respective owners.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Data will be 100% accurate or complete
• The Service will meet your specific requirements
• Any errors will be corrected in a specific timeframe

We aggregate data from public sources and make reasonable efforts to ensure accuracy, but cannot guarantee completeness. You should verify critical data independently.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, METAFETCH SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from use or inability to use the Service
• Damages arising from unauthorized access to your account

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless MetaFetch and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or violation of any rights of a third party.

11. Termination

You may terminate your account at any time through your dashboard settings. We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• Extended inactivity (free tier)

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the modified terms, you must stop using the Service and terminate your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
